1. Gav-Yam Lands Corporation Ltd. and its subsidiaries (the “Company”) respects the privacy of its customers, and of visitors and users of the Company’s website that is available at: gav-yam.co.il (the “Website”) and operated by the Company (the “Users”). The Company places immense importance on safeguarding the Users’ privacy, and is committed to protecting their personal data, and to this end acts in accordance with the provisions of the below privacy policy and the provisions of applicable law.
2. The Company believes that you have the full right to familiarize yourself with the policy pertaining to the collection and use of data we receive from you and collected about you while using the Website. The purpose of the privacy policy among others is to explain the Company protocols in relation to the Users’ privacy and how the Company uses data received from the Users or collected as part of your visit to and use of the Website.
3. Accessing or using the Website constitutes explicit consent to the provisions of the privacy policy. Use of the Website, including any of the services offered therein, is subject to the User consenting to the privacy policy, which forms an integral part of the Company’s terms of use, and which can be found at: gav-yam.co.il under privacy policy. Should you not consent to the terms of use or privacy policy below, please leave the Website immediately.

General

• In the framework of using the Website, you may be asked to provide the Company details about yourself, including full name, email address, phone number and additional identifying details, as required from time to time. You acknowledge that you are not legally required to provide us with any personal information. Sharing personal information with us is voluntary and with your consent.
• Our services are designed for Users over the age of 18. Minors below such age are not authorized to register for or use the services.
• You have the right to review your personal data that is transferred to the Company. You may ask to review such data, and in certain circumstances request to change or erase it, as explained below.
• We do not sell our Users’ personal data to third parties for their commercial purposes. We transfer personal data to third parties only in order to provide the services to our Users, or in other limited circumstances set forth below.
• We may periodically change the provisions of the privacy policy, among other reasons in order for it to reflect technological, business-related, legal or regulatory changes. Should material changes be made to this policy or to the provisions concerning use of personal data you provided, notice to such effect will be published on the Website’s homepage.

Below are details on the categories of data that we collect:

Non-identifiable statistical/aggregate data

4. We collect certain information such as IP address, device model, operating system type, location and other technical data that identify the device through which you connected to the Website. The Company collects non-identifiable statistical/aggregate data that is not stored together with their identifiable data in connection with use of the Website, including User behavior and patterns of activity, offers they showed interest in, pages they viewed, etc. The Company may procure the services of third parties in this context, including Google Analytics. This type of information will not be used to personally identify any User.

Personal data

5. Should you choose to register to receive correspondence from the Company, such as registering to the newsletter and/or receiving marketing information from the Company, we will collect the data you send as part of the registration process.
6. Should you show interest in projects in marketing, appearing from time to time on the Website, we will collect and process the data you provided in connection with specific project/s. This data includes your full name, email, phone number and content of the request.
7. If you are a buyer, tenant, or have chosen to contract with the Company (for example under a sale agreement), we collect certain information about you as set forth in the engagement/sale agreement. This information includes inter alia your contact details, identification details (ID or passport number), financial information (bank account details, payment details, mortgage details etc.). Furthermore, additional information about processing your data in connection with purchasing/leasing a property from the Company is detailed in your engagement agreement with the Company.
8. Should you choose to contact us through the “Contact us” tab on the Website, we will collect the information you sent us in the framework of your request, including full name, phone number, email address and the subject matter of your request.
9. Should you choose to apply for one of the open positions published on the Website under the “Career“tab, we will collect the information you sent us for the purpose of submitting the application, including full name, email, phone number, most recent employment, education, the CV you uploaded, etc.
10. Should you choose to participate in a study or provide feedback in connection with the purchase/lease of a property from the Company, we will collect the information you provided in the study/feedback, for the purpose of improving the service experience and in order to derive insights with respect to the service and sale processes. Such information may include your contact details, responses to the questions posed in the study and more.

 Use of cookies

11. The Website uses cookies to ensure routine and smooth operation, including in order to collect statistical data about the use of the Website, to verify details, in order to customize the Website to your personal preferences, to develop and improve the Website and services provided in its framework, for information security purposes, and more.
12. Cookies, generally speaking, are text files and thumbnail graphics that the User’s browser or platform create by command, and which are placed on the Website’s pages and allow us to identify whether you have taken a certain action. When accessing the Website, the cookies generate a message regarding this action. The cookies are used for collecting non-personal data and allow us to improve the Website pages and our marketing efforts. Some of the cookies expire when the browser or relevant application is closed, and others are saved on the memory of the User’s device or are sent to the Company, including suppliers operating on behalf and for the Company, for the purpose of providing the services offered as part of the Website. 14. Cookies are sometimes also used to render unnecessary the need of typing in the User details during each return visit to parts of the Website that require registration. Therefore, we recommend that you refrain from deleting them, and to only do so when the User is convinced it has saved all required details for use of the Website in a safe place.

The Company may share such data of the Users with said third-party Advertising Companies and even receive such data from them about the Users, for the purposes set forth in this privacy policy.

 How we use the data

17. The collected data may only be used in accordance with this privacy policy and/or pursuant to the provisions of applicable law, inter alia for the following purposes:
    • Execution and management of the contractual engagement with the customers and Users.
    • In order to allow you to use the Website and improve your user experience.
    • For the purpose of responding to requests you send us on various topics, including in respect of customer service, submitting a resume while applying for an open position published on the Website, showing interest in a project/projects in marketing and responding to a service ticket you opened.
    • Operating, changing, developing, improving and enhancing the Website and in order to improve the Company’s activities and services.
    • Locating and preventing viruses, prohibited uses of the Website, fraud or any other violation of the terms of use or of any law.
    • For the commercial and marketing purposes of the Company, including demonstration of website efficiency.
    • To improve our services, conduct surveys and derive insights in respect of the Company’s marketing and sales processes.
    • If you register to receive correspondence from the Company, we will use the details you provided for the purposes of such correspondence.
    • For the purpose of sending various content including commercial offers on our behalf, on behalf of our customers or on behalf of our business partners, subject to your consent and subject to you being able to at any time request not to receive such content and notifications.
    • To comply with the requirements of any law, including for the purposes of legal proceedings, writs, including disclosure orders or requests by any government, regulatory and/or other competent authority.
    • For any other purpose specified in this privacy policy or in the terms of use.

Transfer of the data to third parties

18. Your details and data will not be sent to third parties without your prior consent, unless it is permissible in the framework of this privacy policy, as updated from time to time. Notwithstanding the above, the Company may transfer your personal details and data collected about you to third parties, in the following cases:
    • Transfer of statistical data to suppliers and advertisers about use of the Website. Such data will not identify Users directly.
    • Transfer to our partners such as property development firms or contractors with whom we cooperate in connection with various real estate projects.
    • Transfer to third parties and suppliers who may appear on the Website’s personal area, according to your choice, in connection with the specifications of the property you purchased or leased.
    • Transfer to service providers who help us provide the services to the Users, including cloud services such as CRM service providers, conducting satisfaction surveys, services for operating our Website, digital and media services (including advertising services) and more.
    • Transfer to other third parties for the purpose of sending them marketing, advertising and other materials, which may be of interest to our customers, subject to them being able to request cancellation of the service at any time.
    • For the purpose of direct mailing and direct mailing services via electronic and other means (including through the internet and cellular networks and through any other existing or future method). You hereby agree that the Company, or entities on its behalf engaged in data processing, may contact you, on the basis of you being part of a group with certain characteristics and on the basis of segmentation and profiling activities the Company conducts based on the data it stores as set forth above. The mailing content may include advertisements, value propositions, news material and additional content as the Company chooses. You may at any time ask to cease receiving direct mailing from the Company or request that the information about you not be used for direct mailing activity with respect to certain entities or for certain purposes.
    • For due diligence for the purpose of a potential investment transaction, or in the event of a sale of some or all of the shares or assets of the Company to a third party, or in any other event where the Company reorganizes its activity in the framework of a different corporation – and in the event the Company merges with another entity or merges its activity with that of a third party – it will be entitled to transfer the data in its possession.
    • If a judicial order is received ordering the collected data to be provided.
    • Whenever we believe that transferring the data is necessary in order to prevent severe damage to a User or to the Company.
    • In cases of the terms of use being violated or actions being taken on the Website that breach the law and/or that appear to be in violation of the law and/or an attempt to take such action.
19. You confirm and agree that the information about you may also be transferred outside Israel, including for the purpose of storage and processing, in accordance with the law.

Additional platforms

20. The Website may contain links to various pages, applications and websites on the internet that are not administered and/or operated by the Company or by anyone on its behalf. The Company does not control and/or supervise such pages, applications and websites, and the fact that the Company provides links to such content does not attest to it agreeing with its content and does not constitute a guarantee as to their veracity, accuracy or lawfulness. Use of such pages, applications and websites is subject to the terms of privacy appearing on them, and not to the Company’s privacy terms.

Information Security

21. The Company operates up-to-date systems and processes for information security, which are designed to mitigate the risks of unauthorized intrusion and protect the data the Company collects. Nonetheless, these systems and processes do not provide absolute security, so that the Company does not guarantee that its services are completely immune to unauthorized access to the data stored on them.

Marketing Mailing

22. If you agree to receive direct mailing from the Company, we will send you information, offers and advertisements related to the Company. You confirm that you agree to receive advertisements through the email address you provided us for this purpose. If you do not wish to receive such advertisements, you may at any time withdraw your consent in the direct mailing itself and remove yourself from the distribution list through sending an email to info@gav-yam.co.il.
23. In addition to cases where you provide your express consent to receive advertisements and marketing or advertising offers from the Company or from third parties on its behalf, in cases where you provide the Company with your contact details as part of a contractual engagement between you and the Company (such as a sale agreement), or negotiations leading up to an engagement, the Company may contact you with marketing and advertising offers related to the products and services your showed interest in, in the ways enumerated in the law, without requiring your explicit consent to do so. Naturally, you may at any time request not to be sent more such advertisements, through sending an email to info@gav-yam.co.il or in the manner in which the advertisements are received. This section constitutes notice under section 30A(c)(1) of the Communications (Telecommunications and Broadcasts) Law, 5742-1982.

Exercising my right to review and amend the information about me

24. Subject to the provisions of the law, the Users have the right to review identifiable personal data about them that is held and stored through the Company’s Website and its databases, and even ask to amend or erase it, if they found the data to be inaccurate, incomplete or out of date. Users who wish to exercise these rights may contact the Company in writing in the ways enumerated in the law or by writing to the email address info@gav-yam.co.il; reasonable effort should be taken to comply with these requests, in accordance with the law.

Safeguarding personal data

25. We safeguard personal data for the required and reasonable period of time in order to fulfill the purposes of use described in this policy, to protect or uphold legal rights and claims, and to analyze and improve the services in accordance with applicable law.
26. Please note that we may save non-personal data and statistical data that is not directly identifiable for an indefinite period, and we are permitted to use it among others for analysis and statistical purposes and for any other purpose in the present and in the future for an indefinite period of time.
